DISCLOSURE NOTICE

a) Data Controller and Representative

Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti. (“MKR-IC”) attaches the utmost importance to the security of your personal data. With this awareness, MKR-IC places great importance on ensuring that all personal data belonging to natural persons associated with MKR-IC are processed and retained in compliance with the Personal Data Protection Law No. 6698 (“KVKK”).

Your personal data may be processed by MKR-IC, as the data controller, within the scope described below.

b) Purposes of Processing Personal Data

The personal data obtained may be processed for the following purposes:

  • Establishing and managing the information technology infrastructure, planning and executing business continuity activities, planning and executing corporate communication activities, managing events, carrying out procurement activities, and planning and executing corporate sustainability activities, within the scope of carrying out the work necessary for MKR-IC’s activities and conducting the related business processes;

  • Processing the personal data of employees and job applicants within the scope of the relevant legislation and contracts, and carrying out internship, vocational training, scholarship, and training program activities;

  • Fulfilling the retention, notification, and reporting obligations arising from the relevant legislation, as well as other obligations imposed by legislation;

  • Carrying out the necessary work and related business processes for data subjects who will benefit from the products and services offered and the support to be provided by MKR-IC;

  • Planning and carrying out the activities necessary to customize the products and services offered and the support to be provided by MKR-IC in accordance with the preferences, usage habits, and needs of the data subjects who will benefit from them, and to make recommendations and promotions to such data subjects, in each case within the personal data processing conditions set out in Articles 5 and 6 of the KVKK.

Your personal data and photographs will be processed and stored by MKR-IC in compliance with the KVKK. Your personal data and photographs may be used by MKR-IC in all activities aimed at fostering a sense of corporate belonging, including advertising and promotional activities.

Detailed information regarding the purposes for which your personal data are processed by MKR-IC is provided in the Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti. Personal Data Protection and Processing Policy set out below.

c) To Whom and for What Purposes the Processed Personal Data May Be Transferred

In line with the purposes stated above, your collected personal data may be transferred to our shareholders, affiliates and subsidiaries, business partners, suppliers, public authorities and organizations authorized under the applicable legislation, and other third parties, limited to the fulfillment of these purposes.

Such transfers may be made domestically and abroad, within the framework of the personal data processing conditions and purposes set out in Articles 8 and 9 of the KVKK and limited to the purposes specified in the Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti. Personal Data Protection and Processing Policy.

ç) Method and Legal Basis for Collecting Personal Data

Your personal data are collected and retained by MKR-IC through various communication channels, in physical or electronic form, based on various legal or commercial grounds, for the purposes of providing benefits to you, meeting MKR-IC’s internal requirements, maintaining and developing its activities, or fulfilling obligations arising from the applicable legislation.

d) Rights of Data Subjects under Article 11 of the KVKK

As data subjects, if you submit your requests regarding your rights to MKR-IC through the methods set out in the Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti. Personal Data Protection and Processing Policy, MKR-IC will conclude your request free of charge as soon as possible and, depending on the nature of the request, no later than thirty days.

However, if the requested action requires an additional cost, MKR-IC may charge the fee set out in the tariff determined by the Personal Data Protection Board.

The rights of data subjects in this context are listed below:

  • To learn whether their personal data are being processed;

  • To request information if their personal data have been processed;

  • To learn the purpose of the processing of their personal data and whether they are used in accordance with that purpose;

  • To know the third parties to whom their personal data are transferred, domestically or abroad;

  • To request the rectification of their personal data if they have been processed incompletely or inaccurately;

  • To request the erasure or destruction of their personal data if the reasons requiring their processing no longer exist, even though they have been processed in compliance with the KVKK and other applicable legislation, and to request that the action taken pursuant to this request be notified to the third parties to whom their personal data have been transferred;

  • To object to the emergence of a result to their detriment through the analysis of their processed data exclusively by automated systems; and

  • To claim compensation for any damage they suffer as a result of the unlawful processing of their personal data.

e) Retention Period of Personal Data

The personal data you have shared with MKR-IC through the channels mentioned in this Disclosure Notice will be retained for the periods stipulated in the KVKK and the applicable legislation, where such periods are prescribed.

The actions to be taken upon the expiry of such periods, where a period is prescribed under the KVKK and the applicable legislation, or where no period is prescribed, are set out in the Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti. Personal Data Storage and Destruction Policy.

Pursuant to Article 13 of the KVKK, titled “Application to the Data Controller,” you may exercise your rights set out above and submit your relevant request to MKR-IC in writing or by other methods determined by the Personal Data Protection Board.

To exercise your rights set out above, you may submit your request, including the information necessary to identify you clearly and comprehensibly and your explanation regarding the right you wish to exercise under Article 11 of the KVKK, by completing the application form provided below and sending a signed copy to kvk@mkr-ic.com, or by delivering it in person, together with documents verifying your identity, to Mikroelektronik Araştırma Geliştirme Tasarım ve Ticaret Ltd. Şti., Reşitpaşa Mah. Katar Cad. 4 ARI 3 Teknokent B203, 34467 Sarıyer, İstanbul.

You may also submit your request through a notary public or by other methods specified in the KVKK, or send the relevant form to MKR-IC’s Registered Electronic Mail (KEP) address, mikroelektronik@hs03.kep.tr, using a secure electronic signature.
